I have paid close attention to the “Subic Sham” for over a year and have increasingly been losing my faith in the ability of the Philippine judiciary to serve justice. It’s beginning to seem that the only thing justice is blind to in the Philippines are the facts. It is also concerning that my government is not able to better protect its servicemen while overseas. It makes one wonder what they would be able to do for an ordinary citizen caught in such a miscarriage of justice. Since Lance Corporal Smith’s conviction I have been asking myself if I’m still safe in the Philippines . It’s a question that should concern ordinary Filipinos as well, as they try to come to the table of global trade. Where will they be left when they scare us away? I am not sure what I can do to stand up for Lance Corporal Smith. If nothing else, he remains in my thoughts daily. If you have any suggestions at all as to how I can show more tangible support for Lance Corporal Smith please let me know. He will be in our thoughts long after he leaves the headlines. | ||

Smith never had a chance, from the day early on that a congressman, on hearsay, deliberately described Nicole as having being carried from the van "like a dead pig" (this about a girl from Mindanao) to the "Convict the Rapist" placards outside the courtoom. The law of sub judice, which precludes all public discussion of the merits of a case until the verdict, was never heeded. The Americans will have watched all this with horror and will no doubt do their best to make sure that no more of their citizens in the Philippines are crucified this way. Smith will be repatriated and, before very long, will be out on parole on the grounds that his trial was a display of the degeneration of the Philippine justice system. And that, in my view, would be a fair assessment. Philippine National Red Cross (PNRC) national chairman Senator Richard Gordon and US Ambassador to the Philippines Kristie Kenney personally led the distribution of relief goods to residents devastated by typhoon "Milenyo". Moved by the sufferings and hardships of life shown by the typhoon victims, Ambassador Kenney spent more time with them at the Sorsogon Provincial Gym, extending words of sympathy to the families and encouragement to move on and start life anew. Ambassador Kenney even warmly embraced the helpless children who suffered most from the natural disaster. The American people donated $100,000.00 through the United States Agency for International Development (USAID) to assist the humanitarian relief efforts of the PNRC in order to help the typhoon victims recover and live normal lives in the wake of the "Milenyo" disaster; 3. In the first week of December 2006, an emergency U.S. flight arrived in Manila carrying provisions for victims of super typhoon "Reming”. Ambassador Kenney and Americans are saddened by the tragic loss of life and devastation and committed to continue in partnership with our government in addressing the humanitarian needs caused by the natural disaster and in helping improve health programs and public order and safety; 4. It is generally agreed that the duty of the U.S. personnel to respect the laws of our land and to refrain from any activity inconsistent with the spirit of the Visiting Forces Agreement (VFA) forged between our government and your government in the month of February 1998, as represented by Secretary Domingo L. Siazon and US Ambassador Thomas C. Hubbard, shall always be uphold. I do believe in the pertinent provision of the agreement which is very well interpreted that the custody of any U.S. personnel over whom the Philippines is to exercise jurisdiction shall immediately reside with the United States military authorities, with prior request, from the commission of any offense until completion of all judicial hearings and proceedings. We have closely monitored his case and what I do not understand is why "nicole" from Zamboanga followed these troops to Subic? As a Filipina, it seems very unladylike to do so unless she had motives other than pure ones. Rape is a very strong conviction and I still feel that trouble will follow if you look for it. What is a young filipina doing, drinking 4 different kinds of drinks, dancing in the bar late at night and not expect anything to transpire much less know or is lucid enough to know what transpires.? I still feel that staying home is the Filipina way. I have been in the U.S. for over 30 years and know that the soldiers sent for combat are very young and almost very naive of worldly events. Sometimes things happen when we least expect it but I'm glad you have strong faith that you will overcome this trial. There are people who believe in you, some may not but don't mind them. You told the truth of what happened that night,and you've been honest about it. I grew up in this country so I know who's telling the truth and who's not. One thing I know is that when they don't get what they want they'll bite you in the ass. I guess it was just your so unlucky day. You'll be fine, just remember that people are fighting for you, just be patient. I know this is all new to you but you'll get through it. A woman cannot give consent while under the influence. How about a man? A what point is she under the influence? Use your training to over come this situation and take one day at a time. Use the support of these people within the Philippines who are supporting you for justice. There are a good percentage of Filipinos in the Philippines who know that this case was about face time for the lawyers, the media etc. to put down the US. BE STRONG. I have been following this situation since it was reported in the newspapers over a year ago. I knew that this was going to be a case that would be followed by many in the Philippines and the US. The outcome of the case would be influenced by the media and those groups in the Philippines that have such hatred for the US that these Marines would be hung out to dry. It is sad to see that the people of the Philippines are letting these groups, officials in government, and the those rich take control of this case and turn it into a "joke" of justice for the entire world to see. From the start, you could clearly see that this case was "ONLY" about face time for the lawyers, "Nicole" and those groups. It was NEVER about justice for these Marines. Having been stationed "DITO" in Subic Bay on two tours of duty with the US Navy for a total of 5.5 years and many in port periods with the Navy since 1976. I have first hand knowledge of what goes on in Olongapo City, Barrio Baretto, Subic City. It is sad to see these Filipinas working in the bars, go-go's, etc to make money for their families. But it goes beyond that. It is about a dream of leaving the Philippines, falling in love and finding an American who will take them to the USA. Can anyone fault them for this dream of theirs??? I sure can not. I have been married to a Filipina now for over 30 years and it was the best decision I ever made. On the other hand, I am also aware of the tricks, scams, lies, etc. that were done daily to Sailors, Marines, Airman, and even civilians who worked on the bases. They were set up with the help of local policeman who would break in to the hotel rooms, apartments, etc and threaten these same young men with jail if they did not pay under the table fines. Most would do this to avoid any trouble with the military. It seemed that almost every time the Fleet was in port when I was stationed in Subic, you would hear some situations like above. I am very surprise that now Senator Gordon ( American father, Filipina mother)) who used to be the Mayor of OC did not get involved with this case. I know for fact that when ever a case similar to this came up, he was on it like "white on rice" to put an end to the situation before it got to the media. Again, it was ALL about dollar to those under the table. Now that he is a Senator, I guess he does not want to put his job on the line to support you in this case. If he was called as a witness to the stand and asked about the history of what went on in OC during his time as Mayor, he could share a lot of cases such as yours of where the officials of OC would pressure the Filipina into with drawing her case for money under the table. I wonder how much she really got after ALL those in power took their share???? So LCPL Smith, I hope that you will stay strong, take care of your self and keep the faith with your self and family. Well, at least not directly unless if we probably consider the nitty-gritty of the VFA agreement between our countries from which I believe your case has unfortunately become a victim of. But I am following your case, although not as closely as the anti-American advocates. After having heard the verdict I feel that I want to reach out to you. I do not pity you but I empathize with you. I can imagine the many times you wished that that night did not happen. It might have been better if you had joined us in remembering our “dead” that night (as it is the significance of the 1st Nov for Filipinos) rather than the “one dying” on that day. But I guess it is because you are young and when we are, we feel that we are entitled to be folly once in a while. When I was your age and having been bred in an “old fashioned” Filipino family, I was just in the university. Occasionally, I enjoyed a night-out with known friends. Sitting in a stranger’s lap would have outraged my mother much less ride in a van with four strange men (no matter how young and good looking they are). How I wish we met that night instead. Maybe, you would have wished the same thing knowing that we would both be safe and would pass the hours talking about the Simpsons while sitting opposite each other with a round table in between. You would only be guilty of sleeping at some point which I will easily forgiveJ Anyways, I am not promoting myself here. And it really disappointed me. Yes, I am Pro- “Smith”. The very first time I heard of this case, I already believed that Smith is not guilty of whatever accusations this “Nicole” is throwing on him. Why? Simply because consensual sex between a US Marine and a Filipina is “normal” especially on a place like Subic (ever wonder of the left off Amerasians?) and more especially after having a good time in a club. “Normal” in the sense that most Filipino women flock there and mingle with these US Marines for so many reason at all. One may include prostitution that is sex with pay, and anyone who has knowledge of this situation would really agree. I am not saying Nicole is there for prostitution, I don’t know her. But what was her main reason of going there? Having fun. Talking about morality and decency, is it rightful for a woman to go there and socialize with too many men and get drunk and dance with them? Not to mention drinking too many kinds of alcohol. Her mother should have scolded her of doing so in the very first place. Intoxication and libido – worst words I heard on that “judgement day”. Being intoxicated is already the responsibility of the person being intoxicated. For a woman, immorality again. Smith could have abused her being “intoxicated” but the use of the term, libido, both of them had it. In short, I believe the sexual intercourse was really consensual. The contusions? This is how I see it; they were riding on a van, and having sex at the rear most would be really “difficult” and motion is restricted since the space is too small. As they were both performing the “act”, they could have hit hard those body parts that caused them to bruise. Dumped like a pig? I believe this is overstated just to look more pathetic. The US Marines also have a curfew so they had to leave before the time yet I accept as true that she was left in a better manner than of a “pig dumped”. If she were seen almost naked, well, that could have been the start of her plans to open a case. Asked what could be the motives of Nicole to accuse them? I don’t know if she really wanted to be part of history. Or since she has raised this to the court and to the public, it would be shameful of her to stop it especially that supporters are coming in. I don’t have much to say about her reasons of accusing these men, she knows better. Evidences are mere objects that would imply a happening but not necessarily stating facts. Witnesses are mere people who see the act but not entirely knowing the truth, sometimes misinterpret them, or for some, add and scrap stories. A trial’s should not be primarily based on the number of evidences shown or witnesses that have stood up. I have witnessed the final trial and it just really pissed me off when I saw her jump when it was announced that Smith be detained directly to the Makati City Jail. What kind of reaction was that? Since Lance Corporal Daniel John Smith case’s is pending with the Court of Appeals, I hope that his custody will be remained to the US as mandated at the Visiting Forces Agreement. I hope that this time, his case at the Court of Appeals will be reviewed carefully so that truth would prevail. I just feel so bad about his condition now. I salute all those in the US Embassy who in one way or another never left Smith alone and were always there for him. To Nicole, “God is really good.” and final judgment isn’t here on earth, but on the life after and even during the life span of a human being he/she can feel God’s punishments. You cannot be convicted of a crime that is not alleged in the information because that would be a violation of your right to be informed of the charges against you. For your information, the said article provides as follows: Article 266-A. Rape, When and How Committed.- Rape is committed- 1. By a man who shall have carnal knowledge of a woman under any of the following circumstances: a. Through force, threat or intimidation; b. When the offended party is deprived of reason or is otherwise unconscious; c. By means of fraudulent machination or grave abuse of authority; d. When the offended party is under twelve (12) years of age or is demented, even though none of the circumstances mentioned above be present; 2. By any person who, under any of the circumstances mentioned in paragraph 1 hereof, shall commit an act of sexual assault by inserting his penis into another person’s mouth or anal orifice, or any instrument or object, into the genital or anal orifice of another person. Regarding the reason why the private complainant sued you for rape, it is easy to see why she did so if it should be believed that you left her in an apparent state of undress in a public area where there were witnesses. I can hear the bystanders say, “Hey there’s a condom dangling from her pants’ pocket!” Or “Hey her zipper is at the back!” Of course, under this circumstance, she would tell said bystanders that she was raped because she was ashamed that she was seen in that situation! And when the media caught up with her story, because the bystanders probably brought her to the police, she could no longer retract her story. So you see, if you will incorporate these arguments in your memorandum, you will be acquitted, sooner in the Court of Appeals or later in the Supreme Court. Do not fear. God is on your side. It was obvious that the Leftist organizations and self-serving politicians were determined to turn this case into something political from the get go, in order to try and eventually seek the scrapping of the VFA. The female in question was just an all-to-willing pawn. I have yet to talk to anyone, Filipino or foreigner, who believes that Suzette Nicolas was raped in the van that night. What they do say, especially the Filipinos, is that Suzette Nicolas is nothing but a “Tramp” and that persons not even in the van that night were plotting all along to “Set up” some unsuspecting U.S. military serviceman and blow it all out of proportion in order to advance their own selfish agenda. I find it strange how two members of congress mysteriously appeared on scene, how the son of the Subic City mayor was conveniently there to watch the girl exit the van and how strange it is that SBMA security immediately forced the van’s driver to sign a false statement, but the SBMA security officer has never been charged for assaulting the van driver, nor for intimidating him. The judge in your case, like most judges here, showed bias towards his fellow Filipino by not admitting her past (I have worked in Zamboanga at Camp Navarro and have seen first-hand what kind of loose girls work in the canteen/gift shop area), or allowing the two security guards at Club Neptune to change their statements to what really transpired (I’m sure they were threatened also). No one I know ever thought you would get a fair trial here. Foreigners, and especially Americans, never get a fair shake from the legal system here. I believe that his decision was based on politics rather than facts and he should be ashamed of himself. Guilt must be found as a matter fact, not as a matter of circumstantial evidence. Problems with our government and the corruption of our officials are not your problem and for this injustice I am truly sorry. Although you are away from your family and living under terrible hardship, I wish you the best possible Christmas with hopes that you will be at the embassy rather than Makati Jail by Christmas. By the way, I am Rex A. of San Diego, California and I have been following on the news about you and the 3 other US servicemen that were involved in the case since last year. A lot of Filipinos here in the States were saddened regarding the result of the verdict. Most of us here in the US, especially my colleagues and friends don't believe that you committed the crime. The judge's decision has been so unfair. I know how you were felling that time and your family here has been so worried about you. We've been praying for you for good health, safety and protection. Life is hard inside the jail, but because alot of people have been supporting you and praying for you, you have become stronger emotionally and spiritually, and we're glad to learn that you are doing well. I am writing you this to show my support for you and your family. I have high regards with all the Marine Corps and also with US Army, Navy and Airforce. They are the modern day heroes of the America and the rest of the world - and you are a part of that. Life is short so just live your life to the fullest. Look into the future with confidence and have a positive outlook in life. This experience will make you a better person and I know something good will happen in the end.
